MMKH-Workshop: AI Law in the Higher Education Context – Data Protection Law

This event takes place in German.

This workshop focuses on the data protection assessment of AI systems in teaching, research, and administration. The following key areas will be analyzed from a practical perspective:

- Legal basis for AI use: When is the processing of personal data by AI systems covered by the public interest (Higher Education Act in conjunction with Art. 6 para. 1 lit. e GDPR), and why is consent often an unreliable basis in the university context?

- High-risk systems in focus: Why are stricter requirements for risk management and human oversight applied to AI in admissions procedures or exam assessment (proctoring)?

- Transparency & information: How must students be informed about the logic behind algorithmic decisions, and what labeling requirements exist for AI interactions?

- Third-country transfer & data sovereignty: How should the use of tools like DeepSeek or US-based services be assessed, taking into account standard contractual clauses and the EU-US Data Privacy Framework?

- AI system testing: Conducting data protection impact assessments (DPIAs) and fundamental rights impact assessments (GRIAs) before deploying new tools
